Yesterday the 7,000 DWT chemical tanker YM Uranus carrying pyrogas gasoline was in a collision with the 197,000 DWT bulker Hanjin Rizhao off the coast of Brittany. Contrary to early reports that the chemical tanker was sinking, she remained afloat, despite a significant list, with no loss of cargo. Her crew abandoned ship and was picked up by the French Navy. The YM Uranus is now under tow to the port of Brest.

Well yes of course! How do you ram someone in the stern when overtaking? Rule #28 of ‘Steering and Sailing’ International Rules of the Road states with great clarity how and when to know that you are the ‘overtaking’ vessel. Section(d) of that Rule ends with “or relieve her of the duty of keeping clear of the overtaken vessel until she is finally past and clear”.
The OOW of the overtaking vessel was clearly not ‘watchkeeping’ because one should set a danger area circle of at least 1 nautical mile around the other vessel into which one does not enter.
